AUTHORIZATION TO USE LIKENESS

PSTALENT.COM, LLC, (“PSTALENT”) and/or its Community Producers (“AFFILIATES”) are producing a video or audio project (the “Project”), and may wish to use your recorded voice and/or image in the project. By electronic signature below, you acknowledge your desire to appear in the project without further compensation, financial or gift, and grant to PSTALENT, its AFFILIATES, agents, employees, successors and assigns the following:

(a) The right to use your name, nickname, signature, voice, spoken word, musical performance, dramatic or other performance, photograph, picture, rendering, silhouette or other reproduction in any media you (referred to as your “Likeness”) in connection with the Video Material. PSTALENT is not required to use your Likeness in the Video Material and makes no representation that it will do so; and

(b) All rights of every nature related to the use of your Likeness in the Video Material, including rights of publicity, state-law rights related to use of likeness, copyrights related to your Likeness and the exclusive right to reproduce, exhibit, distribute and exploit your Likeness in the Video Material, in perpetuity throughout the world in any media, whether now known or hereafter devised. These rights include use of your Likeness in connection with PSTALENT products and the products of its affiliated companies. PSTALENT or its affiliated companies may exploit these rights by broadcasting the Video Material in any media, including the Internet or other online media, and may use these rights for any commercial, merchandising, promotional and advertising purpose. PSTALENT may edit, alter or reproduce your Likeness as used in the Video Material for any purpose, and PSTALENT has complete artistic freedom and discretion in doing so. You acknowledge that you have no ownership, authorship or moral rights in the Video Material or any part it and, to the extent that you do, you waive those rights to the extent allowable by law.

You hereby release PSTALENT and its AFFILIATES, affiliated companies, and their officers, directors, employees and agents from claims, demands, actions or causes of action of any kind, nature or description that you or your successors or assigns may now, or at any time, have or claim to have relating to or in any way connected with the rights granted above.

You understand that PSTALENT is not a signatory to any union, and you represent and warrant that you are not a member of a performing arts union and that the consideration provided to you in this release constitutes complete consideration for all uses and re-uses of your Likeness in connection with the Video Material.

Electronic Signature Agreement. By selecting the “I Accept” button, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Agreement. By selecting “I Accept” you consent to be legally bound by this Agreement’s terms and conditions. You further agree that your use of a key pad, mouse or other device to select an item, button, icon or similar act/action, or to otherwise provide PSTALENT.COM, LLC (PSTALENT), or in accessing or making any transaction regarding any agreement, acknowledgement, consent terms, disclosures or conditions constitutes your signature (hereafter referred to as “E-Signature”), acceptance and agreement as if actually signed by you in writing. You also agree that no certification authority or other third party verification is necessary to validate your E-Signature and that the lack of such certification or third party verification will not in any way affect the enforceability of your E-Signature or any resulting contract between you and PSTALENT.
